Trading Terms
1. Introduction
- The terms contained in this document (Trading Terms) apply to all transactions for the purchase of products and services (each a “Service” or, two or more, the “Services”) from the Site. By ordering any Services from our Site you are indicating your acceptance to be bound by these Trading Terms. They form a legal agreement between you and us and can only be amended with our consent. You can print a copy of these Trading Terms by selecting the print option from the “File” menu of your browser.
- In the event that the Site contains separate terms of trading linked to via the Site homepage, in the case of conflict between those terms of trading and these Trading Terms the terms of trading shall prevail over these Trading Terms.
- We reserve the right to change these Trading Terms from time to time without prior notice to you, provided that any such change will not affect any purchases you have made before the change is implemented.
2. Ordering
- You may place an order to purchase a Service advertised for sale on our Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the “Place Order” button on the checkout page.
- All orders placed by you are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.
- After submitting an order to us, you will be sent an order acknowledgement email with your order reference and details of the products you have ordered. Acceptance of your order and the formation of the contract between us will take place when we send you an email confirming that the products you have ordered are being dispatched to you, unless we have notified you that we do not accept your order or you have already cancelled it.
- If your order includes Service(s) which are not available from stock, we will contact you to ask how you wish to proceed. You may wait until the Service is available or cancel your order.
3. Prices and Payment
- The prices of Services are as set out on our Site, in pounds (£) sterling, exclusive of VAT and shipping. Shipping charges are added when you choose a shipping option.
- Prices may change at any time prior to acceptance of your order.
- We cannot accept your order until you have paid for it in full.
- In the event of incorrect pricing, we will contact you. If you do not wish to proceed, or we cannot reach you, the order will be cancelled. Unless dispatch has been confirmed, we are not obliged to supply Services at an incorrect price.
4. Delivery / Shipping
- Subject to availability, we will deliver the Services as soon as possible after accepting your order.
- Delivery will be made to the address specified in your order.
- The precise timing of delivery cannot be guaranteed; some deliveries may require a signature.
- Once delivered, the Services become your responsibility, except where damaged, faulty, or incorrectly delivered.
5. Cancellations and Returns
- Unless an exception in Clause 5.4 applies, you may cancel your order within fourteen (14) days. The cancellation period ends 14 days after you or a designated third party receives the goods. You must notify us with your name, address, and order reference or return the Services.
- To meet the deadline, it is sufficient to send the cancellation communication before the period expires.
- If you cancel, we will reimburse payments received, including basic delivery costs. Reimbursement will use the original payment method unless agreed otherwise. We may withhold reimbursement until goods are returned or evidence is provided.
- You may not cancel if:
- You have unsealed audio/visual recordings or software;
- Services are perishable or sealed for hygiene and unsealed after delivery;
- Services are customised or made to your specifications;
- You have started downloading or streaming the Services;
- The Services become inseparably mixed with other items after delivery;
unless the Services were damaged, faulty, or incorrectly delivered.
- Returned Services must be sent within 14 days of cancellation and no later than 28 days after delivery:
- Pack securely, include the returns note, and attach the returns label.
- Return via courier, recorded delivery, or certified mail. We recommend adequate insurance.
- Our cancellations/returns policy does not affect your statutory legal rights.
6. Faulty Services
- If a Service is faulty or damaged on delivery, we may offer a repair, exchange, or refund. Notify us to arrange a return.
- This does not affect your statutory rights.
7. Service Information
- We attempt to display colours and details accurately, but monitors vary; exact matching cannot be guaranteed.
- Promotions in stores may not be available online and vice versa. Purchases made online do not qualify for in-store loyalty or discount schemes unless stated.
- Sizing information is a guide only. Contact us if unsure before ordering.
8. Orders for Delivery Outside the United Kingdom
- If accessing the Site outside the UK, you are responsible for compliance with local laws. We do not warrant that Services are appropriate or lawful outside the UK.
- You must contact us before ordering for delivery outside the UK. Orders may be refused otherwise. Deliveries may be subject to import duties/taxes, for which you are responsible. You are considered the importer. Cross-border deliveries may be inspected by customs.
9. Security
- Our Site uses a secure server in the ordering process to protect your personal information.
- Before entering billing/shipping details, your browser switches to secure mode and encrypts your information.
- Do not send payment details by email. We are not responsible for losses incurred by transmitting details insecurely.
- Contact us with any security queries.
10. Our Liability
- We are not liable where performance is prevented or restricted due to circumstances beyond our control.
- You are responsible for your use of Services. To the extent permitted by law, we are not liable for unforeseeable losses or business losses.
- We accept liability for death or personal injury caused by negligence, fraudulent misrepresentation, and liabilities not excludable under English law.
- Your statutory rights remain unaffected.
11. Personal Data
- We use your personal information in accordance with our Privacy & Cookie Policy. Please read it carefully.
12. General
- Failure to enforce any right does not constitute a waiver. Rights under these Trading Terms may not be transferred by you.
- If any part is unenforceable, the remainder remains valid.
- English law applies, and disputes will be handled by English courts unless you reside elsewhere in the UK.
- No third party has rights under the Contracts (Rights of Third Parties) Act 1999.
- Delays in enforcement do not prevent later enforcement. If you fail to pay and we continue providing Services, we may still demand payment later.
